Out of Time Employment Claims
Out of time employment claims may have a second lease on life. Did you have an employment claim in the last 4 years that you did not pursue because of the fees involved at the Employment Tribunal?
If you did, you may now be able to make your claim, even though it would normally be time barred. Therefore if, since 2013, you have been unfairly dismissed, had wages deducted unlawfully, if you were not paid notice or holiday pay, you may still be able to make a claim. This will also apply to discrimination claims based on race, religion, sex, pregnancy, disability, age, sexual orientation or gender reassignment.
The recent Supreme Court ruling has said that Employment tribunal Fees were unlawful, therefore if you were prevented from making a claim because of the fees, that was also unlawful. In such a case the normal time limit is likely to be lifted in order that your claim can proceed.
At the moment there has been guidance from the President of Employment Tribunals that all such claims should be stayed until there has been a further ruling. It is important that you get any claim in as soon as possible.
